Faulty License Brings Annulment of Local Marriage

        Before me the undersigned authority, personally appeared the the [sic] persons above named who, being first duly sworn deposes and says that the information given by EACH of them as set forth is true and correct and neither of them are not related within the prohibited degree.

     The marriage of S. H. Jones and Edna Small Jones has been annuled.  Judge George W. Whitehurst in setting aside this marriage which was never consummated, did so on the grounds that the license was illegal; the girl was a minor and did not sign the application for license.
     It will be noticed in the above sworn statement that the county Judge set his seal on a document which reads in substance that both parties appeared before him, yet the document is signed by but one, S. H. Jones.  It will be further noticed that the girl's name is signed by Jones also.  Yet the Judge swears that both appeared.  A part of the statement sworn to, gives the girl's age as nineteen years.  This was sworn to.  Now listen to some of the testimony in the case which was settled by (illegible word) annulment before Judge Whitehurst February 12 of this year.

Q. Edna, in Sept. of 1929 did you go through a  marriage ceremony with S. H. Jones? A.  Yes, sir.


                     Q.  Did you ever live with him as husband and wife?  A. No, sir, I never did.

                     Q.  There was an application for a marriage license made on the 12th day of Sept. with Judge Ross.  I hand you                            a copy of it and ask if you ever signed that?  A.  No, sir I never did sign it.

                     Q.  Did you ever have any relations at all with Mr. Jones as husband and wife?  A.  No, sir.

                     THE COURT:

                     Q.  Was her age stated in the record?  A.  fifteen

                     Mr. Gravely:

                     Q.  When was Edna born?  A.  She was born in 1914.

     Louis O. Gravely of La Belle represented the defendant and obtained an annulment of the marriage.
